Havana VIP Terms and Conditions

BOOKING SERVICES WITH Havana VIP IS SUBJECT TO THESE TRAVEL TERMS AND CONDITIONS.  PLEASE READ CAREFULLY!

All services provided by Havana VIP Tours are subject to the following Terms and Conditions:

Havana VIP Tours (herein after “Havana VIP” and/or “us”) is a registered trademark and DBA of ATLA Group, Ltd, a Pennsylvania USA Limited Liability Corporation. The purchase of any travel services offered by Havana VIP constitutes a contractual arrangement between you and ATLA Group Ltd, and represents your acceptance of the Terms and Conditions set out herein. Please ensure that you read carefully and understand these Terms and Conditions prior to booking. You are advised to check on the Havana VIP website at https://havanaviptours.com/travel-terms-conditions or to request the latest version of the Terms & Conditions prior to booking your travel.

Emails from Havana VIP:

All email from Havana VIP comes from the HavanaVIPtours.com domain. If you receive email that you believe is from Havana VIP from a domain other than HavanaVIPtours.com, please contact us immediately to confirm such communications.

Service Fee & Payments:

Unless otherwise stated to you in writing by Havana VIP, a non-refundable service fee of at least $1750.00 per person per voyage is required for Havana VIP to reserve space for you. Havana VIP may, at its own discretion, require up to 50% of your trip’s estimated cost as an advance deposit before providing any services.

Havana VIP only accepts payment made to ATLA Group Ltd.  US Persons may make payment via check, and, for an additional 3% fee, by our third-party on-line credit card service, Square. Non-US Persons must pay via credit card including the 3% fee charged by Square.

Your booking is not confirmed and payment is not deemed made until the service fee is received and funds deposited and cleared by ATLA Group Ltd’s financial institution. For group travel, the reservation for all members of the group is not made until the deposits for all members of the group have been received and cleared by ATLA Group’s financial institution. Your reservation will be automatically canceled if your payment is not cleared by ATLA Group Ltd’s financial institution. Service fees are required at time of booking to hold or to confirm space for you.  Payment of the service fee indicates you have read and accepted these Terms and Conditions.

Please review and verify your booking invoice and your final travel itinerary thoroughly and contact Havana VIP immediately if anything appears to be incorrect or incomplete, as it may not be possible to make changes later. Havana VIP cannot accept responsibility for incorrect or incomplete itineraries if we are not notified of inaccuracies within five (5) days of sending you your invoice and/or your itinerary. In the case of billing errors, Havana VIP reserves the right to re-invoice you with correct pricing.

To assure your reservations, final payment in full for your travel is due forty-five (45) days prior to your departure date, or on such date as indicated to you in writing by Havana VIP. If final payment in full is not received by the due date, your reservation may be canceled and your service fee, including any airfare deposits (including applicable fees), will be retained by Havana VIP.  Havana VIP is not responsible for canceled land and/or air reservations in the event payment is not received in full by the final payment date. Payment in full is required at time of booking for reservations made within forty-five (45) days of your date of departure.

Booking Cancellations & Changes Fees:

Your deposit of up to 50% of our estimate of your trip cost per traveler is non-refundable, but is transferable. If your booking cancellation or travel date change request is received by Havana VIP forty-five (45) days or more prior to your original the date of departure, you may transfer your service fee to another available travel date departing within six (6) months of your original departure date, or to another traveler of your choosing who will travel within six (6) months of your original date of departure, for a per person change service fee of $250.00.

The full cost of your travel with Havana VIP must be paid no later than forty-five (45) days prior to your date of departure. Failure to pay your travel costs in full forty-five (45) days prior to your date of departure may result in the cancelation of your trip and your forfeiture of any moneys paid to Havana VIP.

Changes or cancellations made to services by third party providers, including for airfare, lodgings, ground transportation, and pre-paid events and activities, are subject to the policies of those third party providers governing changes, cancellation and fees.  It is often the case in Cuba, that activities and/or attractions can close suddenly with no prior warning or explanation. Havana VIP shall make a good faith effort to achieve your changes, provide an alternative activity, or recover your funds, but makes no warranty on the transferability or recoverability of funds or fees paid to third party providers for your travel. You waive all liability for Havana VIP for transfer or recovery of funds from any and all such third party services.

If a booking cancellation is received by Havana VIP after the final payment date of your travel, your non-refundable service fee, and all monies paid by you to Havana VIP will be retained.

You shall be responsible for any and all costs due to changes to airline tickets already purchased for your voyage charged by the issuing air carrier in addition to the change service fee charge by Havana VIP.

Trip Interruption and Cancellation Insurance is Strongly Recommended:

Havana VIP cannot require but strongly urges you to purchase a trip interruption and cancellation insurance policy from a reputable provider that specifically provides coverage for Cuba.  We cannot recommend or endorse any provider, but we are aware that many travelers traveling with us have used Allianz Global Services.  You can read more about health and travel insurance coverage for Cuba related travel on our blog.

Air Travel Arrangements, Changes and Delays:

Air travel purchased through Havana VIP is via independent operators that are not owned, managed or operated by Havana VIP.  Your airline ticket is a contract between you and the air carrier only, even if you purchase the ticket through Havana VIP. You waive all liability for Havana VIP for such air services.

Havana VIP is not responsible if an airline cancels, reschedules, or delays a flight for any reason. You must work with the airline directly to reach your destination or to make any alternate arrangements including amendments to return services.  Please be aware airline fees often apply for modifications to air schedules not related to airline imposed flight cancellations, reschedules or delays. These fees will be payable to the airline directly at time of request.  If you miss your departure flight or connection, it is your responsibility to work with the airline on which you are ticketed to reach your destination.

If you or your airline change your air travel arrangements in any way, it is your responsibility to inform Havana VIP of all such air transportation changes immediately.

No refunds will be provided by Havana VIP for portions of trips missed due to canceled, rescheduled or delayed flights, nor is Havana VIP responsible for any additional expenses you may incur prior to joining your trip if you miss your departure flight or flight connection. If airport arrival pick-up transportation is provided in Cuba as part of your itinerary established by Havana VIP, and you fail to arrive on-time as per your itinerary because you missed your scheduled flight or otherwise rescheduled your arrival in Cuba without notifying Havana VIP Immediately, you will be charged for all additional airport transfer costs by Havana VIP.

If you are traveling to Cuba from the United States, you shall make your own round-trip travel arrangements between your point of origin and your point of departure from the United States to Cuba. In all cases, whether your travel originates from the United States of America or another country, your flight plans must include adequate layover time in order for you to meet the flights to and/or from Cuba.  Havana VIP will not be responsible for any loss resulting from delays, cancellation or changes in international gateways, itineraries or travel dates to and/or from Cuba. We recommend that you do not purchase airline tickets with high penalty charges for changes.

Under the Secure Flight Program enacted by the U.S. Department of Homeland Security, the Transportation Security Administration (TSA) requires airlines to collect information from you for the purposes of watch list matching. TSA may share information you provide with law enforcement or intelligence agencies or others under its published system of records notice. At time of booking travel with air reservations, Havana VIP will on an as-needed basis collect the required information and add it to your air booking to pass to the airline(s) for the Secure Flight Program. The information includes full name, date of birth, gender and redress number (if available). Failure to provide the required TSA information at time of booking will result in the loss of confirmed flights and airfare price as information is required for ticketing. Rebooking lost airfare is subject to schedule availability at time of rebooking and may result in alternate flight schedules and/or increases in airfare price. Any increase in airfare price is payable by you.

Participation:

Havana VIP reserves the right to accept or reject any tour participant and to remove, or otherwise deny service to any participant whose conduct is deemed incompatible with the interests of Havana VIP and/or the public-at-large. Havana VIP will not refund or cover any cost or expenses incurred for termination of travel arrangements due to unacceptable behavior.  Examples of unacceptable behavior include but are not limited to engaging in actions that are illegal under United States of America, International, or Cuban law, and/or inducing or inciting Havana VIP staff and/or contractors to engage in actions that are illegal under United States of America, International and/or Cuban law, and any actions that may be deemed to constitute  a hazard and/or threat to public safety and/or the well-being of other persons or property.

United States Department of the Treasury OFAC Compliance for U.S. Persons:

If you are a Citizen or Resident or any person otherwise under the jurisdiction of the United States of America you are a U.S. Person and you must abide by all U.S. laws and regulations, including those administered by the US Department of the Treasury, Office of Foreign Assets Control (OFAC) regarding travel to Cuba. For up-to-date information regarding your eligibility to travel to Cuba under General or Specific License consult the latest information and regulations published by OFAC at http://www.treasury.gov/resource-center/sanctions/Programs/pages/cuba.aspx.

OFAC regulations require that travel transactions related to Cuba must be directly incident to one of the specific categories of travel authorized by general license published by the U.S. Department of Treasury, Office of Foreign Assets Control or travel must be authorized by a specific license granted on a case-by-case basis by OFAC directly to travelers.

Havana VIP warrants that the itinerary our personnel establish for your travel to Cuba is compliant with United States laws and regulations governing travel to Cuba.  Any failure by you to comply with U.S. law, including any deviation by you from the lawful itinerary established by Havana VIP or any other violation of OFAC regulations by you, shall void all guarantees, warranties, covenants, or conditions offered by Havana VIP.

If you are a U.S. Person subject to the jurisdiction of the United States of America traveling to Cuba, including any United States citizen and/or resident thereof, you must provide Havana VIP with documentation proving your compliance with all U.S. laws, including regulations administered by OFAC, concerning travel to Cuba, including but not limited to a signed and executed Affidavit for Travel to Cuba under General or Specific License. Failure to provide such documentation may result in the cancellation of your travel and the forfeiture of any moneys paid to Havana VIP.  If you are a US citizen or resident, and you have not received a request for such OFAC compliant documentation from us, please contact Havana VIP immediately.

Havana VIP shall provide you with documentation of your licensed travel to Cuba.  You must retain that document and all financial records relating to your travel to Cuba for up to five (5) years for OFAC compliance.

Travelers Who Need Special Assistance:

You must report any status, condition, or disability requiring special attention while on tour to Havana VIP at the time your reservation is made.  Such special status, condition, or disability may include dietary restrictions, physical disability, or religious requirements.  Havana VIP will make reasonable attempts to accommodate the special needs of all travelers, but is not responsible in the event it is unable to do so, nor responsible for any denial of services by air carriers, hotels, restaurants, or other independent suppliers. Havana VIP cannot provide individual assistance to a tour participant for walking, dining, getting on and off motorcoaches, ships and other conveyances, or other personal needs. Havana VIP strongly recommends a qualified and physically able companion must accompany travelers who need such assistance. All travelers with Havana VIP are subject to the Participation clause above.

Not all sightseeing stops/sites accommodate wheelchairs and some locations and sightseeing activities require extensive standing, sitting or walking, sometimes on unpaved or cobblestone streets. Havana VIP is not responsible for any missed activities due to a participant’s inability to participate with the group.

The Americans with Disabilities Act is only applicable within the territories of the United States and facilities for disabled individuals are limited outside its borders.

Personal Safety and Well-Being:

Please be aware that during your participation in travel organized by Havana VIP, certain risks and dangers may arise beyond our control, including but not limited to: the hazards of traveling in undeveloped areas; travel by boat, train, automobile, aircraft, or other means of transportation; forces of nature; political unrest; acts of lawlessness or terrorism; and accident or illness in remote regions without means of rapid evacuation or medical facilities.

Havana VIP will not have liability regarding provision of legal assistance and/or medical care or the adequacy of any such assistance or care that may be rendered during your travel. While Havana VIP will use its best efforts to ensure that adequate measures are taken, by agreeing to participate in travel and/or optional excursions you agree that you will hold Havana VIP harmless regarding any provision of legal assistance and/or medical care or the adequacy of any assistance or care rendered. Havana VIP is not responsible for such risks and dangers that may arise beyond our control.  Payment of your service fee indicates you accept these risks and dangers and agree to hold Havana VIP harmless for such.

Visas & Passports:

If Havana VIP arranges your air travel to Cuba directly from any gateway in the United States, Havana VIP shall provide you Cuban visa(s) at your expense prior to your departure date. If you purchase your air travel to Cuba other than from Havana VIP, whether traveling to Cuba directly or via third countries, visas for travel to Cuba shall be obtained by you prior to your time of airline check-in at your point of departure to Cuba, unless you specifically contract Havana VIP to provide you with visa services at additional cost to you. It is your responsibility to comply with all visa regulations. If you lose, deface or destroy your visa(s) prior to or during your travel such visa(s) must be replaced by you at your own expense.

For all other travel outside of Cuba, you are responsible for obtaining and paying for all visas and entry documents, for meeting all health and other requirements, and for any documents required by the laws, regulations, orders, and/or requirements of the countries you will visit.

Non-U.S. Persons must consult with appropriate jurisdictional consulates to determine if any visas are needed; and if needed you are responsible for obtaining all such visas and entry documents independently. Havana VIP is not responsible for providing you with specific visa and passport information or documentation, for any fees associated with obtaining these documents, and Havana VIP cannot accept liability for any passenger refused entry onto any transport or into any country due to failure of the passenger to carry correct documentation.

All passengers traveling internationally are required to have a valid passport. Most countries require that the passport be valid for at least six (6) months beyond the conclusion of your trip. It is recommended you have a minimum of three blank pages in your passport when traveling, as many countries require blank pages. Multiple-entry visas are required for some travel. It is your responsibility to verify all visa and passport requirements. Havana VIP strongly recommends that all travelers carry with them a legible photocopy of their passport photo/information page.

Photographs or Pictures:

Photographs or pictures appearing on the web site www.HavanaVIPtours.com and in any printed materials provided by Havana VIP should be used solely as an indication of facilities and attractions. Actual facilities and attractions may vary according to itinerary. Maps shown on the website and any other pages are current at the time of printing and may not reflect the actual routing should the itinerary change.

Mediation and Arbitration:

In the event of any controversy or claim arising out of or relating to this arrangement between you and ATLA Group Ltd, or a breach thereof, the parties hereto shall first attempt to settle the dispute by mediation, administered by the American Arbitration Association under its Mediation Rules. If settlement is not reached within sixty days after service of a written demand for mediation, any unresolved controversy or claim shall be settled by arbitration administered by the American Arbitration Association Alternative Dispute Resolution Service under its Commercial Arbitration Rules.

The number of arbitrators shall be one. The place of arbitration shall be Philadelphia, Pennsylvania. Pennsylvania law shall apply. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

Complete Terms and Conditions:

The foregoing constitutes the complete terms and conditions for travel and services by Havana VIP.  No modifications are allowed.
